You bet your tech company's bottom line they are. Some jobs are filled based on a salary with no specifics in work hours. Salary positions are the easiest to exploit and often abused by management. Unfortunately, the only recourse is to quit or find some happy medium with management. At the same time, the media is a very powerful tool for exposing destructive management.
Sexual harassment is completely punishable here in the U.S. and offers no immunity whatsoever to the offending employee regardless of their position in any company or entity. The parent company is also the one left holding the bag if and when lawsuits are filed. Also, if the offending employee touched or groped the other employee appropriately, it could carry a sexual assault charge. The victim therefore stands to have an immense amount of leverage. Any victim terminated by their employer for filing sexual harassment or assault charges are protected by U.S. law no matter their country of origin.
The common trend in import tech companies is to continue to hire from within their ranks from the country of origin. This is extremely frowned upon in many countries as it is discrimination. And, hiring only certain ethnicity even under the guise of language barriers is still discrimination. The ethical ramifications can and usually do result in both public distaste and even legal recourse. This is one area that media is very unforgiving.
It truly is sad that we live in a day and age that we have to rely on every letter of the law to make sure businesses conduct themselves in an ethical, fair way. Non-U.S. head quarter based companies are professional guests. There is no law that excludes them from U.S. laws. A work-VISA is extremely fragile and is often revoked if found guilty of criminal activity.
