Our clan is looking for a cheap, but legal version of Win2003 Server.

We found a guy selling Win2003 Server on E-Bay for $150 he says it's the academic version he got in school with license for the server and 5 work stations and the license has never been activated.

Is this legal?

Yes and no.............yes, it's legal to sell the OS as used, with no warranty. But, you can't guarantee he didn't rip the CD, and keep the serial number.

I asked MS about this once, when I was looking to unload my MSDN subscription stuff I didn't use. Their answer was "we don't advise that you resell used, but as long as you delete the OS, and the new owner activates it on their computer, it's not a problem."

Ask the seller if the package is sealed, and if he says no, skip it. Or, if you do buy it, and the CD has been opened, ask for a refund. An open MS box is a sure sign that while he hasn't activated it yet, he did burn the CD, and probably kept the serial number. With a 5 workstation license, you probably wouldn't even notice, until you tried to add that fifth workstation, and it borked on you.
